Police: (PA)Nanticoke man altered odometer, title of car he tried to sell

NOTFEA

KINGSTON — A Nanticoke man faces multiple charges after he allegedly altered the odometer and title of a car he sold to a Kingston man. State police at Wyoming say Terry Matthew Panetta, 33, acquired a silver Ford Mustang and the title to the vehicle in September 2013, then disassembled the instrument cluster and altered the odometer by “blacking out” digits with a black marker. Panetta then altered the vehicle title to indicate that the vehicle had less mileage than the actual mileage recorded, and then offered the car for sale on the Craigslist website, police said. A 21-year-old man from Kingston responded to the ad, met with Panetta to see the vehicle at a location on Pringle Street in Kingston and arranged to buy the car from Panetta, according to police. After the vehicle sale, the odometer discrepancy was discovered and the Kingston man, whom police did not identify, contacted state police. Following an investigation, police on Tuesday charged Panetta with felony counts of forgery, tampering with public records or information, changing an odometer reading and washing a vehicle title, a misdemeanor count of theft by deception/false impression and a summary count of improper transfer of ownership. Panetta was arraigned before District Judge James Roberts and released on $25,000 unsecured bail. His preliminary hearing is scheduled for 1:30 p.m. Oct. 21 before Roberts. This Cuyahoga Falls Odometer Scam Looks Like Something Straight Out of Matilda

NOTFEA

A Cuyahoga Falls man was indicted on multiple felony charges on Thursday for defrauding car buyers by selling high-milage vehicles on Craigslist after he had rolled back their odometers. Sounds a lot like the Danny DeVito character from the 1996 film Matilda, no? 35-year-old Shannon G. Payne was indicted on six counts of tampering with records and single counts of theft, forgery, and identity fraud reported 19 Action News. The charges involve three instances in which Payne is accused of purchasing vehicles on Craigslist and having the owner assign the title to him. He also used fake power-of-attorney forms and solicited the notary services of his wife in order to obtain replacement titles, after which he rigged the odometers in the vehicles to reflect a lower mileage. Payne’s wife was not charged in the case, but she has surrendered her notary commission. Cuyahoga Falls: BMW Investigations/ Cuyahoga Falls Police

NOTFEA

AKRON, OH (WOIO) – A Cuyahoga Falls man who defrauded car buyers by selling high-mileage vehicles on Craigslist after rolling back the odometers was indicted on multiple felony charges on Thursday, June 27, 2013, by a Summit County grand jury. Shannon G. Payne, 35, who also is a registered sex offender, was indicted on six counts of tampering with records and single counts of theft, forgery and identity fraud following an investigation by BMV Investigations and Cuyahoga Falls police. The charges involve three transactions in which Payne is accused of buying vehicles on Craigslist and having the owner assign the title to him. The investigation found that Payne subsequently used falsified power-of-attorney forms – utilizing the notary services of his wife, Carrianne Payne, to obtain replacement titles – after which he swapped out the odometers in the vehicles to reflect a lower mileage. Carrianne Payne was not charged in the case, but she has surrendered her notary commission. BMV Investigations has identified other apparent victims of this scheme. High-Flying Auto Dealer Employee Steals $10M For Luxuries

NOTFEA

High-Flying Auto Dealer Employee Steals $10M For Luxuries (ABC News) Patricia Smith, the former controller of an auto dealership in Pennsylvania, is headed to jail after embezzling $10 million from her former boss in a stunning case of a trusted employee looting the business then squandering the cash on luxuries. Smith, who worked at Baierl Acura located in Wexford, Pa., an upper-middle class suburb of Pittsburgh, was convicted of systematically stealing for seven years–some $4,000 a day on average–for private jet travel, special trips to the theatre, fancy clothes and other goods, according to the court. A costume fitting on Broadway? Check. Super Bowl Tickets? Check. There were even trips to the Vatican using stolen money. Smith spared no expense for herself or her family on the company’s dime, according to reports from court. The jet charters alone totaled $1.8 million for the high-flying bookkeeper, who officially made about $50,000 a year from the dealership. According to Shannon Pierre, of ABC Pittsburgh affiliate WTAE, who reported on the story from court, Smith’s reason for her crime spree was she felt like a “horrible daughter, wife, mother and friend” and the gifts were a way to “earn their love” because she wanted to see “what happiness looks like.” An attorney for Smith did not return our request for comment. News reports indicated that Smith told her family and friends she got rich investing in airline stock. Now, the woman nearing retirement age must serve 78 months in prison, three years of probation, and pay restitution of $10,349,569.14 for the fortune she obtained by making more than 800 money transfers from the Baierl Acura’s coffers to her personal accounts. “We’re glad that justice has been served and this matter is now behind us. Despite the amount of funds taken over time, there were … Continue Reading

Dealer Says Odometer-Rollback Charges Are Due to Mechanical ‘Glitch’

NOTFEA

The Daily Times of Deleware, Pa., reported this past weekend that one local used-car dealer charged with rolling back the odometer on a 1998 Jeep Cherokee has a different story to tell. The dealer and his attorney are claiming that a mechanical defect was the cause of the erroneous mileage reading. The report stated that David Gill, general manager of DiFilippo Brothers Motor Cars, is being charged with alteration of true mileage statement, deceptive business practices and the misdemeanor charge of tampering with public records. And Gill’s attorney, Michael Malloy, disputes the allegations, blaming the odometer readings on what he called a “mechanical glitch.” Highlighting the background on the case, Gill sold a Jeep Cherokee to customer Rodney Gilmore in December 2010 for $9,295, with an odometer that showed 67,189 miles — according to the affidavit of probable cause written by Pennsylvania State Trooper Louis Vitali. But the PennDOT records painted a different picture: the records obtained by Vitali showed the Jeep’s last reported mileage as 84,210, reported the Daily Times. Malloy apparently said, “We know for a fact now the (odometer) is now back further than when the complainant drove it. “We can’t say why it’s happening,” he was reported saying. But according to the affidavit, Gilmore ran a Carfax report on the Jeep shortly after he bought the unit. And this report showed apparently showed the mileage on the vehicle was much higher. “Gilmore called the dealership and spoke with a woman who confirmed the mileage on the title was in fact 84,210, not 67,189, according to the affidavit,” the Daily Times reported. But Gill claims that on the date of sale, the vehicle title was unavailable and he took the mileage from the odometer to complete the paperwork. According to a report from Vitali, Gill also told him the mileage on the … Continue Reading

Used Car Dealer Facing Charges After Odometer Investigation

NOTFEA

Dave Gill is facing felony charges after complaints by an NBC10 viewer who bought a car at the lot he manages in Prospect Park.   A used car manager is facing felony charges after the NBC10 Investigators looked into complaints that he tampered with the odometer on one of his Jeeps. A Prospect Park used car manager is facing felony charges after the NBC10 Investigators looked into complaints by an NBC10 viewer who bought a Jeep at his lot. Dave Gill is accused of rolling back the odometer on the Jeep. “The charges will be dropped then I’m coming after you,” Gill told NBC10’s Harry Hairston as he was going into court for his preliminary hearing. Gill insists he’s done nothing wrong. He’s the manager of DeFilippo Brothers. Pennsylvania State Police have charged him with Prohibited Activities Relating to Odometers, one of two felony charges leveled against him. This all comes months after the NBC10 Investigators brought you the story of Rodney Gilmore. Gilmore bought a 1998 jeep from DeFelippo Brothers in December of 2010. He says he started to have problems with the car immediately. “It started to over heat, it wouldn’t start, it had issues with the cooling, brakes — there were a lot of issues,” Gilmore said. Gilmore says that prompted him to get a Car Fax. According to state police documents, the report showed the Jeep had 84,000 miles on it when the used car company bought it, which is a lot more than the 67-thousand plus miles on the odometer when Gilmore bought the Jeep. “Somebody, at some point along the line, tampered with the odometer, decreasing the mileage, the shown mileage, which would then be able to provide them an avenue to sell the vehicle at a higher price,” said state police officer Lou … Continue Reading

Raleigh man charged with selling vehicles with altered odometers

NOTFEA

RALEIGH, N.C. — A Raleigh man has been arrested and charged with selling vehicles with altered odometers out of his home. Officials with the NC Division of Motor Vehicles License and Theft Bureau say Francis Marimo had been under investigation for months after a customer reportedly purchased a 2005 Honda Odyssey through an ad on Craigslist. The victim later discovered that the vehicle mileage had been changed. During the investigation, agents learned Marimo would travel to different states to purchase the vehicles, then return to Raleigh where he would allegedly change the odometer cluster and then place the vehicle on Craigslist for sale. On Tuesday inspectors seized four Honda odometer clusters, $17,200 in cash, keys to different vehicles, motor vehicle titles, and paper work pertaining to the sale of vehicles. Marimo was charged with two counts of odometer fraud, two counts of obtaining property by false pretenses, and one count of acting as a motor vehicle dealer without a license. He was placed in jail under a $3,000 secured bond. Bureau officials say they continue to look into how long Marimo had been making such sales and says more charges are possible. Anyone who thinks they may have been a victim of the fraud is asked to call the Bureau at (919)816-9194, ext. 2. Posted by Gary Mitchell
